Is ADA Really A Vending Machine Concern?

Well I was working on finding out more about what exactly were the ADA rules for a vending machine because customers are asking about the machines they install. So after a few calls back and forth with the department of justice I found out what I thought was the case to begin with, most vending machines do not have to worry about it as they are not fixed items.
It was confirmed by the Department Of Justice that if a vending machine is not fixed to the structure then it does not fall into the regulations as the regulations are for fixed items only.
A good way to determine this is if you turn the building upside down what would fall out.
The vending machines even though they are plugged in to the wall are not part of the structure and probable never will be.
I also ask about well what about the grocery stores with those coolers like we are now using in Micro Market Vending how do they qualify as well as the high shelves, answer was that the Department would not place any burdens on a business that would cost them so much to fix it would or could have a serious impact on their business.
So the rules have been laid out and really they will not affect vending machines most of the time.
